Why the permissive option keeps collapsing
Hosts that advertise tolerance for malware, phishing and carding are not shielded by law. They are shielded by obscurity, and obscurity has a short half-life. Transit providers depool them once abuse reports accumulate. Their address ranges land on every blocklist worth having, so anything legitimate sharing that space silently stops working. Eventually a coordinated operation empties the racks, and seizures take whole cabinets rather than individual machines.
If your infrastructure lives there, your real risk was never a takedown notice. It was that the building gets cleared one Tuesday for reasons entirely unconnected to you, and your data goes into an evidence bag with everyone else's.

Those two positions look contradictory only if you assume a host must either police everything or nothing.
