Terms of Service

The rules that govern the relationship. Written to be read once and understood, rather than to survive a lawsuit unread.

These terms are the agreement between you and NoDMCAVPS for every service ordered on nodmcavps.com.

The account

An account is an email address, a password and a balance. You are responsible for everything done through it, including by anyone you give the credentials to. Because we hold no identity data, we cannot restore access to an account whose email and password are both lost — there is no alternative proof of ownership we could accept, and inventing one would defeat the point of the design.

Balance and billing

  • Services are prepaid. You fund one balance in cryptocurrency and every product draws from it.
  • Hourly services bill by the hour and stop billing the moment the instance is destroyed. Monthly services bill for the term.
  • Balances never expire and are not frozen during a dispute.
  • Crypto top-ups are final once confirmed on-chain. We cannot reverse a settled transaction, and neither can anyone else.
  • If a balance runs to zero, services are suspended rather than deleted, and data is retained for a grace period before reclamation.

What we will suspend for

Services are suspended without notice for material or activity prohibited by our Acceptable Use Policy, for attacks originating from your infrastructure, and for a valid order from a court with jurisdiction over the facility. Nothing else triggers a suspension. Specifically, an automated copyright notice concerning a service in a safe-harbour region does not, on its own, cause any action to be taken against that service.

Two tiers of region, honestly labelled

Safe-harbour regions are outside United States jurisdiction and outside the reach of the statutes that make an automated notice legally operative. Standard regions in Germany, Singapore and Japan are ordinary commercial locations where local law applies in the usual way, and we will act there when local law requires it. Choosing a standard region for its latency is a reasonable decision; choosing it and expecting safe-harbour treatment is not, and we label the two separately so that mistake is hard to make.

Availability and liability

We target 99.9% availability per calendar month, excluding announced maintenance and events outside our control. Where we fall short, the remedy is a credit to your balance proportional to the downtime. Our aggregate liability is limited to what you paid us for the affected service in the month concerned. We are not liable for your data — take your own backups, ideally somewhere that is not us.

Changes

Material changes to these terms are announced in the client area before they take effect. Continuing to use the service afterwards constitutes acceptance; if you would rather not, destroy your services and withdraw the remaining balance.
